An
owner is a person who holds title to a home at Mill Brook.

A resident is a person whose full time and primary home is at
Mill Brook.

A tenant is a person who rents a home from an owner at Mill
Brook.
-
A roommate is a resident who shares a home with an owner at
Mill Brook.

A company car is a vehicle that a corporation or business holds
the title to and requires the resident to use for business purposes.
-
A commercial vehicle is a van, flat bed truck, one-ton truck
or other vehicle that has signs, equipment or other commercial
aspects. They may be affixed to the outside or be contained
in the interior.

All other vehicles including motorcycles are considered personal
vehicles.
-
A reserved space is a numbered guest space that has been put
aside for the exclusive use by members in good standing who
have more than two (2) vehicles.

A member in good standing is an owner who is current with dues
and is not subject to a disciplinary action.

A
visitor is a guest who parks overnight at Mill Brook.
-
A frequent visitor is a guest who parks overnight several times
a week or month on a repeated basis.

An extended visitor is a guest who will be temporarily staying
with a resident for a period of time no less than 1 month and
no more than 6 months.
2.
Garages:
-
Residents are to use their garages to park their vehicles.
-
Garages are not to be converted into any use (such as a recreation
room or storage) that would prevent its use as a parking space
for the number of vehicles the garage was designed to contain.

New residents have a 2-week grace period before being required
to park all vehicles in their garage. Parking Committee must
be informed to avoid being tagged.

Parking in front of the garage is allowed for loading, unloading,
washing cars and other short-term temporary activities.
-
The streets of Mill Brook are Fire Lanes. This is indicated
by the red curbs.

Residents are not allowed to park overnight in guest parking
unless they have permission from the Parking Committee, Board
of Directors or the management company.

Vehicles
parked overnight in the Fire Lanes (streets) will be towed without
warning at the owner's expense.
-
Residents
found parking overnight in the parking lot without permission
may be towed without any warning at the owner's expense.
-
No parking or storing trailers, boats or immobile vehicles in
guest spaces.
-
RV's cannot be parked overnight at Mill Brook.
-
No auto maintenance or repair of any kind can be performed in
the guest parking spaces or the reserved parking spaces.
-
Parking in the street around the mailbox is prohibited for safety
reasons.
-
The speed limit within the complex is 15 MPH as posted at the
entrance to Mill Brook.

Residents may not park in Reserved Spaces not rented by them.
Failure to abide by this rule will result in towing at the owner's
expense.

Residents
are responsible for informing the Parking Committee and the
Management Company whenever the vehicle situation changes, such
as adding, selling or buying a vehicle.

Commercial vehicles are prohibited from parking overnight in
the parking lot.
-
All parking spaces will be painted as either "Guest"
or "Reserved". All reserved spaces must be numbered
and in such a way as to not connect to the address of the renter.

Visitors are not allowed to park overnight more than 3 nights
without permission from the Parking Committee, Board of Directors
or Management Company.

Visitors parked more than 3 nights at Mill Brook will be tagged
on the fourth consecutive night.
-
Residents must call the Parking Committee with their name, their
unit number, visitor vehicle information including license number,
and the expected departure date of their visitor if staying
more than 3 nights.
-
Excessive parking is defined as parking overnight 50% or more
per month per authorized visitor vehicle.
-
Authorized frequent visitors who exceed the 50% excessive parking
rule will be towed after 1 warning at the owner's expense.
5. Assignment of Reserved Parking Spaces:
-
A maximum of 20 reserved rental spaces will be made available.
-
Rental spaces shall be uniformly distributed throughout the
complex.
-
Parking space groupings of two will have no rental spaces.
-
Parking space groupings of three may have one rental slot assigned.
-
Parking space groupings of four or five may have up to two rental
spaces assigned.
-
Approximately half of the rental spaces shall be located by
the end of the swimming pool or at the end of housing units
so that views out of front windows are minimally impacted.

If there are no Reserved Spaces available then a third vehicle
must be parked off Mill Brook property.
-
No more than one car per household may be permanently housed
in a rental spot without permission from the Board of Directors.
-
The Board of Directors and/or the Parking Committee will assign
rental spaces on a first-come first-served basis during the
year.

The Board reserves the right to use the priority list to determine
eligibility to lease a reserved space in the event that either
vehicles or owners requiring reserved spaces number more than
the number of spaces available.

Tenants are not eligible to lease a reserved space.
-
Renewal is not automatic
-
Vehicle information must be updated before November 1 so it
can be included in the lease.
-
Failure to return signed lease, copies of DMV registrations
and a check in the full amount by November 1 will result in
a warning that the reserved space will default to the Association.

Failure to turn in the lease by November 15 will result in the
following actions:
· The reserved space will be returned to the pool of
available spaces and may be assigned to another resident.
· Any vehicles parked in reserved spaces without permission
and authorization from the Committee, Board or other representative
of the Association will be towed without notice and at the expense
of the owner of the vehicle.
· A late fee of $10 may be assessed.
8. Lease Procedures:

The
renter of the space is responsible for policing the reserved
space.

The renter of the space is responsible to call the Parking Committee
or Management Company in the event that an unauthorized person
parks in their reserved space.

The renter of the reserved space may request that unauthorized
vehicles be towed without warning at the vehicle owner's expense.
-
The Board of Directors or the Parking Committee may cancel the
lease at any time if the space is not maintained as directed
by the CC&R's.
-
The Board of Directors may be petitioned for a variance in case
of special circumstances.
-
The Parking Committee is the contact for lease requests changes
or refunds.
